ADA Mediation |
The purpose of the Americans with Disabilities Act of 1990 is to remove barriers to a full and productive life for those with disabilities. About 12 percent of the workforce today has a bona fide disability which the Americans with Disabilities Act of 1990 will support. We came together to mediate the disagreement between Edward Burton and Emily Mitchen of State College.
Mr. Burton is a college sophomore at State College; he is studying music and conducting. Mr. Burton was injured about five years ago in a car accident and was left wheelchair bound. According to our text “Under the ADA, a disabled person (1) has a physical or mental impairment that substantially limits one or more life activities (2) has a record of such impairment, (3) is regarded having such impairment”. (Tony McAdams, Nancy Neslund, Kiren Dosanjh Zucker, 2009) Mr. Burton qualifies under the ADA because of his disability. He can study composition almost anywhere and this does not pose a problem for him or the college because the buildings he needs to access for this study are equipped to accommodate those with physical disabilities. The hardship for him is attempting to access the music building to study music and practice with his violin. Mr. Burton claims that access to the music building is vital to his studies and claims he has accessed it in the past with assistance and at the inconvenience of his friends. He is requesting that State College renovate the music building to be accessible for all students with disabilities.
Professor Emily Mitchum is representing State College in this matter. She is a professor of Music in the Arts & Sciences department at the college, but also is responsible for the upkeep of the music building. She has two concerns about renovating the music building; cost and that ascetic change to the building. Because the building is more than 200 years old and has maintained its...
