Sanity: the condition of being insane, a derangement of the mind. Syn: Dementia, lunacy, madness, craziness, mania and aberration. All ways to label the spectrum of behaviors that manifest as violations of social norms. Insanity can consume people from many different walks of life, with varieties of disorders and of any race or gender. Insanity, which would appear to be a mental problem, no longer holds a place in the medical world. Insanity can be driven from other forms of mental disabilities such as bipolar, schizophrenia or psychotic disorders. It does however hold a strong stance in our court of law, you can either plea guilty, not guilty or insane.. How is it fair to sentence someone with insanity if you cant even define it? They have rules for the real mental patients that cant control their actions, criminals deserve punishment not evaluation. In today’s society, pleading insanity is one of the hardest defenses to successfully achieve. Most of the population believe that the insanity defense is used more often than it actually is and believed that the defense is used to avoid punishment.   In law, Mens Rea means having had criminal intent, or guilty mind, when the act (actus reus) was committed, and this should hold true to every crime. The mens rea is the mental element required for a crime and if absent excuses the defendant from criminal responsibility and punishment. Knowing this, Is the insanity plea really necessary?
The insanity defense has been around for a long time. The first formal definition of legal insanity was adopted with the trial of Daniel M’Naghten in 1843. M' Naghten was arrested for attempting to shoot Prime Minister Sir Peele. M’Naughten had gone after the Prime Minister because he believed the Prime Minister had caused many of his misfortunes.
