The policies of the victim and the accused are at either end of the spectrum when it comes to the criminal justice system. The policies for the victims are to protect them from further victimization. The accused policies are to ensure the rights of the accused are not violated and that the guilt is convicted not the innocent.
The definition of the term victim is any individual against whom an offense has been committed. A “victim of crime it is meant ‘a person who has suffered direct, or threatened, physical, emotional or pecuniary harm as a result of a commission of a crime” (Smartt, 2006: 16).
All local, state and federal criminal justice system have victim policies. These policies are in place to make sure that the victims are respected, treated with sensitivity to the crime that was committed against them and treated with the dignity. There are certain policies in place that make sure a victim is informed of “the arrest of the accused, bail proceedings, pretrial, dismissal of charges, plea negotiations, trial, sentencing, appeals, probation or parole hearings and release or escape of the accused” ("The National Center For Victims Of Crime", 2012).  This policy is for the protection of the victim, so they do not become a victim due to lack of information from the criminal justice system. Victim policies also require a speedy trial, return of the victim’s property if any was obtained, restitution, compensation, and protection from the accused.
In all the criminal justice system the victim is entitled to protection. The protection can be from threats, intimidation or retaliation. The policy for protection can vary depending on the law enforcement department and the case. The local law enforcement can handle protection of a witness or victim by having them stay in safe houses with police escort and security until the...
