No matter what day and age, abortion has always been a delicate issue. Depending on your religious circumstances and opinion, you could believe abortion is a diabolical idea created by humans, or you could believe abortion is a right to every human being that should be and is protected. Laws have been created that defend both sides of the argument, but still contain many unsolved questions. Currently, there are both the Parental Notification laws and the Partial Birth Abortion Ban enforced within the United States. A very select few were able to make these laws and bans legal, but evidently both the Parental Notification laws and the Partial Birth Abortion Ban are unconstitutional, proven by a plethora of ways, including the Cur Process Clause and the 14th Amendment.
The Parental Notification law is unconstitutional on a plethora of levels. Because of the Parental Notification law, 22 states require one or both parents to consent to having an abortion, 11 states require one or both parents be notified and 2 states require both consent and notification before an elective abortion can occur. ("Minors and abortion,") In some special circumstances, judges are allowed to issue court orders that permit minors to obtain abortions without parental involvement. For example, in West Virginia a doctor with no financial ties to the abortion provider can bypass parental involvement. Some states also allow grandparents or other family members to be involved in an abortion decision in lieu of the parents. Without looking at the special circumstances, these 35 states are going against our 14th Amendment rights. Within the 14th Amendment, the Due Process Clause within the amendment prohibits state and local governments from depriving persons of life, liberty, or property without certain steps being taken to ensure fairness.
