At the core of the death penalty debate is when to exercise this form of irreversible punishment and to whom does this punishment apply. “Britain influenced America's use of the death penalty more than any other country. When European settlers came to the new world, they brought the practice of capital punishment. The first recorded execution in the new colonies was that of Captain George Kendall in the Jamestown colony of Virginia in 1608; Captain Kendall was executed for being a spy for Spain” (deathpenaltyinfo.org, n.d.).   Shockingly, research shows that executions have less to do with the crime and are influenced by race, geography, politics and budget considerations (Anonymous, 2011). Far too often we hear of cases where inmates were released from prison after being cleared of their crimes due to new evidence such as DNA results proving that the alleged defendant was innocent. “Through early 2008, DNA analysis and other new technologies have exonerated 15 death row inmates” (Schaefer, 2009). While the judicial system is based on the principal of innocent until proven guilty, in all actuality it is really the opposite. We base our fact finding on the presentation of evidence, testimonies by “experts” in their fields and possible eye witnesses and we present this to a group of individuals who are supposed to provide an unbiased decision based on the details provided. However, attorneys are paid legal representation hired to present a very persuasive and compelling argument and while the fate of another hangs in the balance we entrust this task to another. The skill and expertise of the attorney determines the outcome of the trail and the punishment handed down to the guilty defendant. My position does not negate the crime committed; it is merely to present the full scope of the process.
